Judge Towery has allowed McDonald to move to unsupervised and frequent visits with his two year old son, and Towery has repeatedly ignored the child's mother's request to reinstate mandatory alcohol testing Mc Donald was under back in 2016. In James Towery’s family court, poor or self-represented litigants don’t get the same celebrity treatment that Towery, an admitted 49er fan , gives McDonald. In case after case, Judge James Towery appears to subject mothers and innocent fathers to supervised visits or supposal support termination where non- violent DV claims are alleged. Mothers who have fought for custody or support, and fathers who have filed to legally stop move away orders get decaled vexatious, subjected to DVROs themselves as litigants like McDonald pay lawyers in Towery’s favor to get away with fraud and violent abuse. Confidential files leaked to the press show that Santa Clara County’s family court supervising Judge Emede signed orders giving McDonald increased visitation, as McDonald spent millions on lawyers to continue to buy his way out of criminal conduct. All this occurred as the child’s mother was underrepresented by Legal Aid and unethical lawyers like Heather Smith, whom the State Bar never investigated or disciplined. Judge James Towery's former connection to California's State Bar, and the role that connection has to allowing abuse in family law matters is now facing heightened scrutiny. The Santa Clara County District Attorney and police have unclean hands as well , as the DA’s office and law enforcement continue to botch investigations related to DV and rape. This misconduct is reportedly the reason SWAT is being called in to take over on yet another rape allegation involving former 49er Ray Mc Donald. Women politicians, leaders and activists are fed up. Nearly one year after Brock Turner allowed to serve only 6 months in jail for the rape of a woman on the Stanford University campus, and just months after CEO Abhishek was allowed to stay in the country and face only 30 days in jail for abusing his wife, another rape charge against violent abuser Ray Mc Donald is calling for federal investigations of Silicon Valley misuse of domestic violence cases in California's family courts.
