Women Judges and Lawyers Caught With Unclean Hands in Judge Conrad Rushing Sexual Harassment Scandal
Judge Patricia Lucas may pay for the sins of Judge Conrad Rushing, who resigned under a cloud of sex scandals that rocked California's judiciary earlier this month. Rushing asking women staffers to pack his apartment pails to the harm Rushing and Lucas have done to thousands of men and women in Santa Clara and Monterey divorce cases.
No sooner had the ink dried on Rushing's resignation letter, when a federal lawsuit naming Rushing and a host of women judges was filed The lawsuit is being served on Santa Clara County Judges over the holiday break, and has already been served on the Attorney General and could cause the loss of federal funding for Santa Clara County and the State of California related to guideline child support.
Lucas, who caused outrage for her support of Judge Persky following the sentencing of Brock Turner, is said to be the subject of another recall, and impeachment campaign that is expected to hit in 2018, the year Lucas is up for reelection.
As the new family courthouse was built, Lucas was reportedly credited with getting the nearly $300 million courthouse built., largely with the help of private donations which were pimped out by Lucas who rallied support from the most corrupt family law attorneys in the state.
The San Jose Mercury reported that courthouse ( in the first year open) has sucked $105 million dollars in losses and people actually have less access to justice than before the courthouse was built. Wait time in Santa Clara Family law cases to file documents now exceeds 4 hours for pro per litigants, while lawyers who helped pay the fees to build the court are allowed to submit electronically or in shorter lines.
The courthouse also appears to be being funded with inflated fees for court reporters who are widely known to change transcripts to benefit judges. These court reporters are unlawfully charging fees to pro per litigants and the court, which the court has refused to audit or control while Patricia Lucas acts as presiding judge for the county and where she also serves as legal advisor on the state's Judicial Council and for Monterey and Alameda counties.
However, it is the rapid escalation of state and federal grants funding services for domestic violence that may be keeping the courthouse alive. Lucas has reportedly created a culture where women and men without wealth and status are subject to DVROS, vexatious litigant designations or criminal claims that earn the county courts money. DV has become an epidemic and county judges appear to be issuing DVROs for little or no reason , while letting real abusers off the hook when they pay the lawyers donating to Lucas' political campaigns.
As Rushing grabs headlines for what he did to court staff, few have noticed what Rushing did as a Santa Clara County Judge and then as an appellate judge, which created a culture that Patricia Lucas has continued. A culture very harmful to women involved in the county divorce and custody cases.
As a trial court judge, and former member of the Elkins Task Force, Lucas has been an abomination for women and families. where gross unfairness was a general policy and practice. The most vivid example is the case involving Kathey Fyke's divorce matter. In that case. Lucas and Judge Clark ambushed Fyke to force her to trial when she was suffering from a life threatening heart condition. The transcript describes the usual treatment of pro per litigants and women in general as Ms. Fyke's medical condition, documented by a licensed physician was dismissed as "not credible".
Lucas, who acted as the All Purpose Judge in Ms. Fyke's divorce case, laid a blueprint for corrupt lawyers like Lynne Yates Cater. Since that case Santa Clara County family law attornies have openly engaged in Antitrust like activity that serves to convert millions in community property to attorney fees.
Leaving Ms. Fyke without legal representation, bankrupt and deathly ill from the clear stress and trauma a Santa Clara County divorce is one of the worst abuses of women possible. Judge Conrad Rushing was on the appellate panel that upheld Lucas' orders and let Lucas off the hook for having never provided justice, or attorney fees, for Ms. Fyke in a divorce proceeding that spanned 10 years. Lucas also clearly acted to protect lawyers, court reporters and bailiffs over Ms. Fyke in hearing after hearing. Lucas even appears to have misused the DA's office and the Santa Clara County Sheriff to discredit Ms. Fyke and cleanse her judicial hands.
Lucas, who was once passed over for a court of appeal appointment is no stranger to misconduct herself. While being considered for the court of appeal, court clerks and lawyers were aware that Lucas tried to "clean up her files" , that were under state review. Such conduct is criminal, and Lucas was never investigated and has now cozied up to the regulators and agencies who would investigate her, effectively subverting an investigation of conduct that includes misuse of public funds. Now a federal suit naming Lucas could change that and expose it all. It also could mean the loss of millions to Santa Clara County in State and Federal Funds, where Lucas sits on numerous committees and panels.
Falcone and Fyke is used as a blueprint to steal children and convert community property to attorney fees, which was confirmed by Judge James Towery at a Santa Clara County Bar education training on April 28 , of this year. Mary Greenwood , now an appellate court judge, attended that training, and along with Towery taught lawyers how to make even more money off divorce and custody cases. Lynne Yates Carter was the key speaker at that meeting where she disparaged Ms. Fyke and gloated over the fees she assisted Richard Falcone earn in what is surely one of the counties most corrupt divorce cases.
The court, and judges like Patricia Lucas, repeatedly tear down women during divorce cases, getting results for a "select" group of lawyers , and destroying women so completely that it makes Conrad Rushing look like an Eagle Scout.
