Calif​ornia is a Community Property State. Meaning spouses are told that assets and income accumulated during marriage are considered commuity property at the time of death or divorce. In reality modern spouses are finding that during a divorce family court judges are determining property accumulated during marriage to legally belong to the spouse with the favored attorney. 

Leaked documents and information show that California's pre- divorce industry is thriving. Most spouses have no idea they are being set up as pre- divorce planning often occurs long before a divorce petition is filed in court.  So how can you tell if your spouse is planning to join the scam? Look for the following : 
  • Formation of bank accounts titled in the name of only one spouse. 
  • Interest in Bitcoin , or cryptocurrency apps and investment. 
  • Refinancing of real property for no legitimate purpose. 
  • Jewlrey and gold purchases 
  • Sudden change in CPAs or legal represenation for busienss or other purpose. 
  • Secret accoutings
  • Re- Titling the Family Home, vacation and investment properties  in one spouses name alone. 
  • Increased friendliness with real estate agents connected to Intero,  owned by Berkshire Hathaway and Coldwell Banker, real estate companies whose agents are being court appointed in divorce cases as part of a case rigging scheme. 
  • Complaints over children's misbehavior.

Whistleblowers associated with California's largest law firms are reporting that the pre- divorce industry has become more lucrative for family law cases, especially when real estate and and child cusotdy issues can be used to incite spouses into spending more money for attorneys.  

If you suspect your spouse of consulting with lawyers in advance of a divorce, it is important to investigate conflicts and retain an attorney from out of the area willing to expose conflicts that lead to the loss of the family home and to parents not  having 50-50 custody rights of their own  children.  
  
The pre- divorce industry is fueld by public corruption and real estate equity.  Once a divorce is filed, a spouse unwilling to quickly settle on issues related to custody or real estate, may be part of a scheme that allows protection for child abuse, sexual abuse , domestic violence or white collar crimes. 

Family law cases arising from wealthy and middle class neighborhoods are seeing an uptick in fraud and corruption that is not being addressed by the local district attorney, the state bar, the Commission on Judicial Performance, or the state's Attorney General.  

California's family law community has been able to thrive by isolating vicitms. No longer are judges merely assuring the equal division of assets. Public court judges are instead allowing cases to drag out for years, depleting community property estates, and protecting litigants engaged in criminal or absuive conduct by forcing fraud and abuse to be addressed in family court where no jury , or media , is watching 

If you suspect fraud, it is important to consult with a civil attorney who practices outside of the local family law club so tort and other claims can be persued while you still have access to money and home equity.
