On August 10, 2016 California Assemblywoman Catharine Baker finally did what no state politician has been able to do in 50 years, she brought the state legislature together, listened to outraged parents and family court litigants and demanded a state audit of California's Commission of Judicial Performance , which promises to finally shed light on California's out of control judges.
For the last two decades family courts have spiraled into a state of dysfunctional justice. Parents have lost children, for no reason, and probate and divorce judges (who likely never took a college math course) divide property in a manner that is nonsensical.
Many, many complaints have been lodged with politicians and California's legal watchdogs , such as the State Bar and California's Commission on Judicial performance, the state funded agency designed to keep judges in line. Less then 2% of complaints are ever investigated and as a result lawyers and judges have run rampant with misconduct, cloaked in judicial immunity and litigation privilege.
This audit is the promise of holding judges accountable for misconduct, judicial retaliation and bias.
Parents and litigants have been screaming about incompetent and unfair judges for decades, where nobody in state office seemed to have been listening.
Millions of families were negatively impacted as a result.
But these parents and litigants evolved. They organized. They used the internet. They attended meetings. They wrote letters. They started petitions. They found good lawyers and reporters sympathetic to the great injustice and they spoke up until they were finally heard .
Mainstream media ignored the plight of these parents, picking up an occasional story , but ignoring the overall issues that left the state's legal system failing so many families and children.
On August 10, 2016 the effort of hundreds of parents, investigative reporters, pro bono attorneys and their supporters paid off.
California judges were not pleased. Evidence of judicial retaliation for those who spoke up is more than apparent and the elite association representing the judges has spent months trying to quash the audit.
