Santa Clara County has been known for judicial misconduct for years. Evidence appears to support claims that hundreds of complaints to California's Commission on Judicial Performance related to Santa Clara County judges have simply been ignored by California's judicial watchdog and California's Supreme Court.
In June 2016, the rest of the world began to see what Santa Clara residents have had to contend with and millions of people cried foul after Judge Persky allowed a convicted white rapist to serve only six months in jail.
Judge Persky appears to have adopted a probation report without using any judicial thought and by ignoring the powerful meaning of a jury conviction. In a judicial process known as " rubberstamping ".
Presky is no different than the countless other Santa Clara County Judges who rubberstamp forensic CPA reports, and custody evaluator reports and reports from realtors , even when the reports are materially false or unreasonable.
Court records show Santa Clara County judges continue to ignore socioeconomically disadvantaged litigants and impose gender bias both Santa Clara County's criminal and family law cases at an alarming rate. The link appears to be tied to certain judges , lawyers and experts in a troublesome network, that is a matter of public interest.
Silicon Valley Divorces More Costly than Stereotypic Hollywood Divorces . Sergey Brin, Google Founder and Anne Wojcicki Founder of 23andMe Settled for a reported $30 billion , to avoid Santa Clara Courts .
Investigators have uncovered that the money spent on a core group of lawyers handling Silicon Valley divorces outstrips anything spend on celebrity divorces in Hollywood, even divorces as public as the current scandalous Johnny Depp divorce . It is reported that while the Google divorce settled privately for about $30 Billion , that before Sergey Brin and his former wife Anne Wojcicki settled, they dumped almost a billion into the corrupt family law community , that fueled crooked lawyers and experts to reach new lows.
Santa Clara County judges, all who were former lawyers in Silicon Valley, appear to be encouraging costly divorces that drag out divorces for even middle class residents 5-10 years.
For example, in the upper middle class Wahl Divorce, Mr. Wahl was reported to have gone into the law offices of Brad Baugh , issued a blank check and instructed Mr Baugh to "make his ex wife's life miserable" . While ethical family lawyers would reject such a client, Brad Baugh welcomed him and spent $5,000,000 of Mr Wahl's money, just fighting for custody, which a Santa Clara County judge allowed to go on.
It is also reported by family law insiders that during the infamous Woznick divorce, that the Santa Clara County judge allowed that famed tech couple to rack up millons fighting over everything , including who would get to open the family Chrsitmas cards. The ripple of that divorce continues to haunt Santa Clara County, where the Sixth District had to rule on an appeal in 2015 to addess Wozniak property, that involved Wozniak's first wife.
Not only judges, but lawyers in Santa Clara County appear to who have a " fix" on these judges that is a great concern to public interest.
In the late 1990s Mary Ann Grilli used to disclose that a lawyer she regularly appointed as a children's lawyer had been the political fund raiser for her election campaign. Grilli soon stopped the disclosure but continued to make the appointment, where hundreds of litigants claimed to have lost custody time with their children in a game they believed Mary Ann Grilli, Santa Clara County's longest sitting family law judge, appears to have rigged.
Judges know the county's crooked lawyers and do little about them.
During a 2016 long cause divorce hearing, Santa Clara County Judge Mark Pierce had marked for evidence an email sent by ethically deficient family lawyer , Brad Baugh.
In the email Baugh wrote to his client, Robert Bassi, a middle class Silicon Valley seed farmer, and appears to have lead his client to believe that he had such a fix on the Santa Clara bench, that he could assure Robert Bassi his former wife would be sanctioned, grinded down and dragged through litigation in a " slow process" that would deprive her of her fair share of community assets gained over a 23 year marriage.
Judge Pierce, in what appears to be corrupt rubberstamping for lawyer Brad Baugh, refused to admit Baugh's email into evidence, citing attorney- client privilege. Pierce then went on to sanction the wife $120,000 , while he denied the wife legal fees and tried to sway future judges to declare the wife vexatious. A vexatious litigant label would further restrict any wife's right to a fair divorce in Santa Clara County.
In addition to the legal misconduct of Santa Clara County judges, the ethical and personal conduct of judges must also be considered, as a matter of public trust in the judiciary.
Whistleblowers have reported James Towery for his incessant sexual harassment and utter disregard for women litigants and women in the county's family law community who reject his sexual advances. For years Towery is repotted to have carried on affairs with lawyers like Valerie Houghton and Heather Allan. Some are even questioning if Towery might have fathered children with lawyers he has carried out affairs with, then ruled on support, property and custody issues where those women lawyers regularly appear before him.
Women on Santa Clara County's bench also are reported to have misused their power as well, and may also be influenced by sex. Mary Ann Grilli is reported to have had a longstanding sexual relationships with lawyer Brad Baugh. It is rumored that in addition to sex, Baugh has assisted Judge Grilli in concealing her personal prescription drug misuse, family problems and early stage dementia , which would have required Grilli to leave the bench years ago.
In the late 1990's Grilli used to make " on - record " disclosures about lawyers and experts who appeared to impose a conflict of interest in family law cases before her, including Johnston, who ran Grilli's election campaign, then was regularly appointed by Grilli in custody cases. Hundreds of moms complained Johnston was so corrupt, that even 50- 50 custody was unheard of.
Court records show that Brad Baugh is awarded more fees and sanctions in cases before Mary Ann Grilli , than any other lawyer in the county.
In case after case Baugh is awarded $100,000 in made up sanctions, where other lawyers and litigants fight tooth and nail for $10,000 or less in attorney fee awards.
Is Judge Mary Ann Grilli using her judicial authority on the Santa Clara County bench to pay for her own personal gigolos ?
Santa Clara Family Court's are out of control. Judges like Takaichi , Grilli and Towery are driving the cost of support and custody cases to an unconscionable level, where the only people who benefit are crooked lawyers, vocational experts, forensic CPAs , custody experts and psychologists. All professions constructed and supported by a flawed family court system.
Judges like Pierce and Persky are imposing the same unethical conduct in the county's civil and criminal cases.
On August 10, 2016, the litigants California courts have labeled as crazy, disgruntled and irrational will finally be heard by the California legislature.
Pressure for a state audit of CJP , the Commission on Judicial Performance, will finally demand that the state audit and manage California's judiciary.
The California Judge's Association ( CJA ) is of course fighting this effort and trying for their own solutions, like the fox guarding the henhouse.
